What is an H1B visa?
This type of U.S. work visa is issued to high-skilled professionals working in scientific or technical fields at the request of a U.S. employer.
The good news for these visa applicants is that the Department of State announced that it recognizes the positive impact of H1B visa holders on the economy of the United States. Therefore, the government will promote the facilitation of nonimmigrant work visas processing.
The H-1B visa features are as follows:
- It is a non-immigrant visa designed for professionals who come to temporarily work in the United States in a particular field: medicine, health care, sociology, physics, mathematics, architecture, engineering, etc.
- H-1B non-immigrant work visas to the U.S. give their holders the right to work exclusively for the U.S. employer who has filed the petition.
- The H-1B work visa is issued strictly for a specific occupation. A person may only transfer to another employer after obtaining permission from Citizenship and Immigration Services.
Although this type of visa is non-immigrant, the H-1B falls under the category called "dual intent visas". Its holder may plan to move to the United States on a work visa.
Spouses and minor children of H1B visa holders may obtain an H-4 visa, allowing relocation to the United States. Note that an H4 visa doesn’t provide its holder with a right to work: an additional work permit is required.
H1B visa requirements
A U.S. work visa in 2022 is issued under an important condition: the American employer is looking for a highly qualified professional and cannot find the right candidate in the United States (which is possible to prove on paper). In addition, a H1B visa applicant must meet the following requirements:
- Have at least a bachelor's degree or work experience in the specified field (3 years of work for one year of study);
- The employee's credentials and skills must meet U.S. standards.
When applying for a U.S. work visa, difficulties are not excluded. The most common reasons for an H1B visa refusal are as follows:
- Filing a petition by a small company. In this case, there may be doubts that the organization really needs a specific specialist;
- The applicant has insufficient English knowledge (even if the work does not imply the fluency in English);
- An uninformative petition with little information about the applicant, their employer, and their activities;
- An incomplete petition with little information about the applicant, their employer, and their activities;
- The company has small office space or an unstable financial situation.
H1B visa application process
To get an American work visa in 2022, the applicant must first fill out the Labor Condition Application (LCA) form and submit it to USCIS (US Citizenship and Immigration Services).
Once the form is approved, the prospective employer must complete Form I-129 (Petition for Alien Worker) and collect additional documentation. The employer should then submit the documentation to the USCIS Immigration Service Center. When the USCIS approves the petition, the U.S. consulate will issue an H1B work visa. In most cases, an interview for an H1B visa is not required (as for 2022).

- A completed DS-160 form;
- Consular fee receipt. In 2022, the H1B visa cost is $190;
- H1B Visa approval notice (I-797 Form)
- Applicant’s CV
- A copy of a U.S. bachelor's degree or equivalent foreign degree.
- A copy of the state license of the employer's lawful business registration.
- A copy of the employer's contract with the applicant. If not available, a document describing the intended terms and conditions of employment is acceptable.
You should begin the H1-b visa application process 6 months before you come to the United States. The H-1B is valid for up to 3 years and may be subsequently extended.
While in the US, during the validity of a work visa or during its extension, it is allowed to apply for a Green Card.
US visa photo requirements in 2022
In order to apply for a US work visa, you must provide a sharp and high-quality photo without any blurs or defects. The US visa photo requirements are as follows:
- Width and height of 51 x 51 mm (2x2");
- The head size from 25 to 35 mm;
- Photo format : JPEG;
- Photo must be in color;
- File size up to 240 Kb;
- Resolution of 300 to 600 pixels;
- White or light-colored background;
- The maximum allowe compression is 20:1;
- Photo must show applicant's face in the center of the frame, full-face. Neck and partial shoulder girdle must be visible;
- Headdresses are prohibited, except for religious paraphernalia, which must leave the oval of the face open;
- Glasses are not allowed;
- Any kind of a uniform is not allowed;
- It is better to choose dark-colored clothing with a contrasting background;
- The picture must be new, taken no later than six months before you apply.
